1. Introduction

1.1. Welcome to 1Home's website. These terms and conditions outline the rules and regulations for the use of 1Home's website and the purchase of products from our online store, as well as the services provided when using our products. By accessing this website, we assume you accept these terms and conditions. Do not continue to use 1Home.io or its products if you do not agree to all of the terms and conditions stated on this page.

1.2. The services provided by 1Home to you under these Terms and Conditions including the 1Home website, hardware products, cloud services, mobile and web applications and other services and functionality ('Services') are provided by 1Home Solutions GmbH, a company registered in Germany (Register Number: HRB 204121 B, Register Court: Amtsgericht Charlottenburg (Berlin) with the address at Friedrichstrasse 114a, 10117 Berlin, Germany).

1.3. Our Cloud service provider is Hetzner Online GmbH, located at Hetzner Data Center Park, Nuremberg, Germany.

2. Orders

2.1. All orders are subject to acceptance and availability. If the goods ordered are not available, you will be notified by email (or by other means if no email address has been provided) and you will have the option to either wait until the item is available or to cancel your order.

2.2. We reserve the right to refuse any order at our sole discretion.

3. Pricing and Payment

3.1. All prices on the website are in EUR and the VAT is additionally calculated in accordance with the shipping destination, unless otherwise specified. Products shipped outside of the European Union may be subject to taxes, customs duties, and other fees charged by the authorities of the country of importation and you are responsible to pay them.

3.2. We reserve the right to change prices at any time without advance notice.

3.3. Payment must be made in full at the time of ordering. We accept payment by credit cards or PayPal.

4. Shipping and Delivery

4.1. We aim to dispatch all orders within 3 working days. Estimated delivery times are to be used as a guide only and commence from the date of dispatch. We are not responsible for any delays caused by destination customs clearance processes.

4.2. Shipping costs will be calculated and added to your order total during the checkout process.

4.3. In accordance with DAP (Delivered at Place) Incoterms, the risk of loss and title for products purchased from us pass to you once the products have been delivered to the agreed-upon destination. Until delivery is completed, we retain responsibility and the title to the products.

5. Returns and Refunds Return Policy

5.1. We are committed to ensuring your satisfaction with your purchase. You may request a refund within 30 days of receiving your order. After 30 days from the delivery date, we are unable to offer refunds or exchanges. Following your discussion with our support team where a return has been agreed, the item must be shipped back to us within 10 days. Please refer to the 5.2. section for additional details.

5.2. Shipping: To return an item, please first contact our support team. They will arrange a DHL pickup at a location of your choice. While we cover the cost of return shipping, we do not refund the original shipping costs incurred at the time of purchase. Refunds are limited to the cost of the product itself. Shipping times for exchanged products may vary depending on your location. We will replace items only if they are defective or damaged. While it is not mandatory to provide a reason for your return, we value your feedback and strive to enhance the experience for all our customers.

5.3. Eligibility for Refunds and Exchanges: To qualify for a refund or exchange:

  • The item must be in its original condition as received.

  • It must be returned in the original packaging.

  • A receipt or proof of purchase is required to process your return.

Once we receive and inspect your returned item, we will notify you via email of its status. If approved, your refund will be processed. Please note that the condition of the item may impact approval.

5.4. Refund Process: Upon approval of your refund, we will initiate the transfer of funds to your original payment method. The time it takes for the refund to reflect in your account may vary depending on your bank's processing times. If you have not received your refund after following up with your bank and credit card company, please contact our support team for further assistance.

6. Prohibited Use and Access Restrictions

6.1. When using 1Home products or services, you shall not access, store, or share any viruses or materials that are unlawful, harmful, threatening, defamatory, obscene, or discriminatory. This includes promoting illegal activity, violence, or sharing explicit content. 1Home can disable your access if these rules are violated.

6.2. Additionally, you shall not copy, modify, or distribute the software, reverse-engineer or attempt to access the source code, use the services to compete with 1Home, sell or share the services with others, except authorized users, and or allow unauthorized access or attempt to obtain the source code. You are responsible for making a good faith effort to prevent unauthorized access and must promptly notify 1Home if such access occurs.

7. Warranty

7.1. As the manufacturer, we provide a 2-year warranty on all our products in accordance with applicable statutory rules, particularly sections 434 et seq. of the German Civil Code (BGB). This warranty covers any manufacturing defects or faults arising from normal use during the warranty period. Please refer to the product documentation for further details.

7.2. An extended warranty for the goods supplied is only available if expressly stated in the order confirmation for the respective item.

7.3. Our warranty ensures that any defects resulting from manufacturing or material faults will be addressed promptly, in line with the applicable legal provisions and our commitment to quality.

8. Proprietary Rights

8.1. By using our website and services, you acknowledge and agree that 1Home and/or its licensors own all intellectual property rights in the software, services, hardware and documentation. Except as expressly stated herein, these Terms and Conditions do not grant the users any rights to, or in, patents, copyright, database right, trade secrets, trade names, trademarks (whether registered or unregistered), or any other rights or licences in respect of the software, services, hardware or documentation.

9. Limitation of Liability

9.1. To the fullest extent permitted by law, 1Home shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the website or products; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from our website; (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our website by any third party; (e) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the website; and/or (f) the defamatory, offensive, or illegal conduct of any third party.

10. Force Majeure

10.1. 1Home shall have no liability under these Terms and Conditions if it is prevented from or delayed in performing its obligations under these Terms and Conditions, or from carrying on its business, by acts, events, omissions or accidents beyond its reasonable control, including, without limitation, strikes, lock-outs or other industrial disputes (whether involving the workforce of 1Home or any other party), failure of a utility service or transport or telecommunications network, natural disasters, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm, acts of third parties.

11. Privacy

11.1. Your privacy is important to us. Please review our Privacy Policy for detailed information on how we collect, use, and protect your personal information. By using our website and purchasing products from us, you consent to the data practices described in our Privacy Policy.

12. Governing Law and Final Provisions

12.1. The laws of the Federal Republic of Germany apply to contracts concluded between 1Home and you. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded. You irrevocably submit to the exclusive jurisdiction of the courts in Germany.

13. Changes to Terms and Conditions

13.1. We reserve the right to modify these terms and conditions at any time without prior notice. It is your responsibility to review these terms and conditions periodically to stay informed of any changes. Your continued use of the website constitutes your acceptance of the modified terms and conditions.
